CONDITIONS OF ENTRY

Information on how to claim your Voucher is part of the Conditions of Entry (Conditions). Submitting a claim for a $20 gift voucher (Voucher) is deemed to be an acceptance of these Conditions. The Promoter may at its discretion refuse to provide a Voucher to any claimant who fails to comply with these Conditions.

Promotion commences at on 01/10/09 and ends last mail received on 30/11/09 (the Promotion Period).

Entry is open to all residents of Australia that participate in the 30 Day Challenge during the Promotion Period (Eligible Claimants). Employees, directors, management, licensees and contractors of the Promoter, its related companies or agencies associated with this Promotion and the immediate families of the above listed persons are ineligible.

Claim and Voucher

To participate in the 30 Day Challenge, you must during the Promotion Period:

(1) Purchase the Required Quantity of two Pro10 Active™ products (Promotion Products). The Required Quantity is a minimum of two packs of Pro10 Active™ 525g. You can purchase the product in more than one transaction provided that the purchase receipt dates are not more than 15 days apart and are within the Promotion Period;

(2) Retain the original receipt(s) of purchase (or photocopies of them); and

(3) Consume minimum one 35g serve of Pro10 Active™ each day for a minimum of 30 consecutive days.

If, after completing the 30 Day Challenge, you do not feel better*, you can claim the Voucher by:

(1) visit www.pro10active.com.au/challenge and print the claim form. Or call us (free) during Melbourne business hours on: 1800 257 650 and we will send you the Claim Form.

* for the purposes of this promotion 'feel better' relates to general well being including improved energy, reduced tiredness, improved gut condition (improved regularity, less bloating, cramping, general non-specific discomfort).

(2) complete the form and send it, along with your original receipts (or photocopies) and proof of ID to:

Claims must be made within seven days of consuming all two packs of the Promotion Products.

All claims must be received by last mail of 31 December 2009. The Promoter takes no responsibility for late or misdirected claims or for any delays in Australia Post's handling of claims. Claims received after this date will be deemed invalid and ineligible to receive a Voucher. No extensions will be given under any circumstances.
Claimants are responsible for all postage costs in making a claim.

Only a legible photocopy of the original receipt of purchase (or legible original receipt of purchase) verifying the date of purchase, price of purchase, and product type purchased, and indicating full and final payment in respect of one or more of the Promotion Products within the Promotion Period will be accepted.
Claimants who make a valid claim will be entitled to receive the Voucher, subject to the restrictions outlined above. Claimants can only make one claim per person during the Promotion Period. Households will be entitled to a maximum of one Voucher.

How claims are satisfied

Where a valid claim has been made, the Voucher will be send to the claimant by means of a $20 gift voucher. It is the claimant's responsibility to ensure that the correct name and address are provided on the claim form. The Promoter accepts no responsibility for Vouchers sent to an incorrect address.

General Conditions

The Promoter's decision is final, and no correspondence will be entered into.
The Promoter, in its absolute discretion, reserves the right to verify the validity of all claims and to disqualify any claimant who tampers with the claim process, including but not limited to, techniques designed to avoid purchasing the Promotion Products, or by making a claim with stolen, forged, mutilated or tampered with receipts of purchase, or who submits an entry that is not in accordance with these Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter and its associated agencies or companies accept no responsibility for lost, late, stolen, damaged or misdirected claims. Incomplete, indecipherable, or illegible claims will be deemed invalid.
If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its absolute discretion to modify the terms of the Promotion including these Conditions.

The Promoter, its associated companies, contractors, employees and agents will not be liable for any claims, losses, damages, injuries, costs and expenses (including but not limited to indirect or consequential loss) whatsoever which are suffered, sustained or incurred as a result of, arising out of or in any way connected with the Promotion, the Promotion Products or the Voucher, except for any liability which cannot be excluded by law.
Any tax liability arising as a result of receiving the Voucher is the responsibility of the claimant.
All claims become the property of the Promoter.

By claiming the Voucher, the claimant consents to the Promoter using the claimant's personal information to administer the Promotion and consents to the Promoter disclosing the claimant's personal information to organisations that assist the Promoter with administering the Promotion, and to third parties as required by law.

By claiming the Voucher, the claimant also consents to the Promoter using or disclosing the information provided to it in relation to this Promotion for future promotional and marketing purposes in relation to any of the goods or services of the Promoter (including notifying the claimant of competitions, offers and rewards via email), without any further reference or payment or other compensation to the claimant.

The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth). Claimants can access and correct the personal information the Promoter holds about them by contacting the Promoter on 1800 257 650 (FREECALL).
